Terms of Service & Booking Terms

These Terms of Service ("Terms") govern your use of basinstays.com(the "Site") and any reservation you make directly with Basin Stays, operated by Christian's Rentals LLC ("Basin Stays," "we," "us," or "our"). By using the Site or booking a stay, you agree to these Terms.

Bookings and payment

  • A reservation is confirmed only when you receive a written confirmation from us and any required payment has been processed.
  • Payment is due as stated at the time of booking. All amounts are in U.S. dollars unless noted otherwise.
  • Payments are handled through our secure third-party payment providers. You agree to provide accurate, current billing information.
  • We may decline or cancel a booking if payment cannot be processed, if information appears inaccurate or fraudulent, or if the reservation violates these Terms.

Taxes

Stays of fewer than 30 nights are subject to Texas Hotel Occupancy Tax, currently 13% total(6% Texas state and 7% City of Odessa), which will be added to your reservation where applicable. Stays of 30 nights or longer are generally exempt from hotel occupancy tax.

Cancellation and refunds

For stays booked directly with Basin Stays, the following cancellation policy applies unless a different policy is stated in your booking confirmation:

  • 100% refund for cancellations made 14 or more days before check-in.
  • 50% refund for cancellations made 7 to 13 days before check-in.
  • No refund for cancellations made fewer than 7 days before check-in, or for no-shows.

Long-term stays (30 nights or more) may be subject to different cancellation terms, which will be provided at the time of booking. Refunds are returned to the original payment method. Taxes and applicable fees are refunded in proportion to any refunded amount.

Check-in and check-out

Check-in and check-out times are provided in your booking confirmation. Early check-in or late check-out may be available upon request and is not guaranteed. Access instructions are shared before arrival.

House rules and guest conduct

  • The property may be occupied only by the number of guests stated in your reservation. Unregistered guests and events or parties are not permitted.
  • No smoking or vaping indoors. Quiet hours and any additional house rules provided must be respected.
  • Pets are allowed only where expressly approved in advance and in accordance with any applicable pet policy or fee.
  • You agree to treat the property with care and to promptly report any damage or maintenance issues.
  • You are responsible for the cost of repairing or replacing property that is damaged, lost, or removed during your stay beyond normal wear and tear.

Rental agreement

For certain stays, we may require you to sign a separate rental or occupancy agreement. Where a signed agreement is required, it forms part of these Terms, and any specific provision in that agreement controls to the extent it conflicts with these Terms.

Assumption of risk and limitation of liability

You and your guests use the property and its amenities at your own risk. To the fullest extent permitted by law, Basin Stays and Christian's Rentals LLC are not liable for any injury, illness, loss, theft, or damage to persons or personal property arising from your stay, except to the extent caused by our gross negligence or willful misconduct. Our total liability relating to a reservation will not exceed the total amount you paid for that reservation.

Indemnification

You agree to indemnify and hold harmless Basin Stays and Christian's Rentals LLC from claims, damages, or expenses arising out of your stay, your use of the property, or your violation of these Terms or applicable law.

Right to refuse or end a stay

We reserve the right to refuse a booking or to end a stay without refund if a guest violates these Terms, the house rules, or applicable law, or engages in conduct that endangers the property or others.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Ector County, Texas.

Changes to these Terms

We may update these Terms from time to time. The version in effect at the time of your booking applies to that reservation. Continued use of the Site after changes take effect means you accept the updated Terms.
